Catherine Rose Design: Design Contract 

This Design agreement is between Catherine Rose Design (designer) and _____ (client) with respect to design services being rendered for _____(address) by Designer for Client Dated _____

Upon signing this agreement designer shall receive a payment in full of : $500 

Which includes the following room(s) and additions:

Designer and Client agree as follows: The following deliverables and services at the flat fee rate. $500 per room (rooms defined by their use i.e. living room vs dining room/kitchen). 

The Flat Fee is calculated at the hourly rate of $62.50 per hour for an estimated 8+ hours of design work. 

Due dates for deliverables are to be set between the client and the designer. One main space typically takes 10-14 days. 

*Please understand that once the designer has begun the design process as indicated by the signing of this contract, the design fee is non-refundable, since the design fee covers the designer’s time and intellectual property. 

Flat rate design fee to include: 

1.) Initial consultation which includes going over the client’s welcome packet completion and reference of measurements completed by client as outlined in the welcome packet. (Typically between 1 to 2 hours), Ideally this initial meeting can be a video call or phone call, or email. All available documents from client must also be sent by email to the designer. 

***Client to send any and all design inspiration upon the initial consultation. Pinterest boards, design magazines, pages and any other images are helpful as well. 

***Designs are comprehensive. If the client would like the designer to design around an item of the client’s choosing the designer would need to know that within the initial consultation as well. After the design process has been initiated, if the client purchases or finds a new item on their own, please understand that the designer may not be able to incorporate this into the original design. A new object affects each and every piece around it and the designer will do their best to incorporate the new piece. But if the cohesive look of the room requires a re-design,  re- negotiation of the contract may be required. 

2. Floor plan / Space plan for the project. The designer will create a computer aided design floor plan to scale for the client using the furniture items selected for the project. If there are multiple rooms and they are connected, the spaces may be combined into one complete floor plan at the discretion of the designer. See an example outlined in the welcome packet. 

This floor plan acts as a template for the furniture placement and functionality of the newly designed room(s) and is for the clients use as well. 

Designer’s floor plans (and other drawings or any other documents) are conceptual in nature and are intended to illustrate design intent; they are not to be used for architectural or engineering purposes. Designer services do not include modifications to kitchen cabinets, structure, appliances, heating, air conditioning, plumbing, electrical, ventilation or other mechanical systems in the project. The designers work does not include services from contractors like architectural, plumbing, installation, lighting and engineering contractors. The designer shall be held harmless for relying on accuracy of information provided by the client. Project drawings and documents cannot be used by the client for any purpose other than completion of this project as laid out in this agreement. 

  1. One Photoshop “Vibe” Board per space. The designer will utilize the information shared within the client’s welcome packet to compile a general direction board for the project. Where spaces share an area vibe boards may be combined at designer’s discretion. See an example outlined in the welcome packet. 

  2. One Photoshop Design Board per space. The designer will utilize the information gathered by response of the corresponding vibe board to create a final design board illustrating all of the elements in the completed design. Where spaces share an area design boards may be combined at designer’s discretion. See an example outlined in the welcome packet. 

  3. A Shopping List will be compiled by the designer as designated in the welcome packet. 

*Catherine Rose Design is not responsible for the availability or quality assurance of each individual piece. The designer cannot guarantee the prices of merchandise, interior installation, or other services not performed by the designer. Vendor pricing is subject to change which is out of the control of the designer. Clients are encouraged to use their own discretion in regards to outside vendors. If the products are unavailable within thirty days of the completed project, designer will reselect the item to the best of their ability at no additional charge. 

6. Installation Instructions as needed on a project by project basis will be outlined by the designer as well (see examples within the welcome packet). 

7. Additional Selections. If the client wishes to see additional options of individual items after the presentation is complete, the flat rate covers ONE additional selection per item. Re-selection of items is non-transferrable between items, and only one submission for re- selected items is covered under this flat rate design fee. All re-selection of items must be requested at the same time so that the designer can create a new cohesive look for the client. A second mood board illustrating the new selections (excepting client found items) can be rendered for the client at an additional fee of $100 to be paid on time of request. 

The design fee does not include:
-any additional re-selections for individual pieces beyond the included ONE re-selection per item 

-any “re-dos” of the photoshop vibe or design boards
-and “re-dos” of floor plans
-coordination or installation of purchased furniture
-shopping consultations

-communication or coordination with outside contractors or tradesmen
-in person meetings

*above mentioned services will be billed separately at a rate of $90 an hour with a 2-hour minimum. The scope of which will be estimated, agreed upon and invoiced to client and is payable by the client upon receipt of invoice, before additional work commences. 

Photographs and publicity:
Client agrees to allow designer and or designer’s representatives to photograph project during all stages of design services including when project is complete. Photographs will be used for business purposes, including but not limited to: press, publications, online, social media, marketing, advertising, and print. Designer will not disclose address or client’s name without prior consent. Costs of photographs and publicity are the responsibility of the designer. Additionally if the client or client’s agents document the project, the designer shall be given credit as the designers if documentation is released publicly, always with designer’s prior consent.The designer retains the ownership of the design concept, copyrights, sketches, plans and 3D drawings, samples, swatches, intellectual property, patents and any other materials prepared for the project. The client does not have the right to share or use the design for any other project except the said one without the explicit written permission of the designer. 

Signing this document indicates that the client is in possession of the welcome packet, understands its requests and will complete the contents to the best of their ability with assistance from the designer.

Work commences on date of invoice payment.

TERMS: The parties agree that the terms of this agreement may be changed only in writing and must be signed by both parties and that no oral changes or waivers are permitted.
